Velocci UK LTD – Host Terms of Service

These Terms of Service for Hosts ("Terms") govern your use of the LocalStays platform ("Platform"), owned and operated by Velocci UK LTD ("Velocci," "we," "our," "us"), through which property owners, property managers, or other authorized representatives ("Host," "you," "your") may offer accommodations ("Listings") to guests seeking short- or long-term stays ("Guests").

By registering as a Host or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Nature of the Platform

  1. The Platform enables Hosts to publish Listings and Guests to request bookings.
  2. Velocci is not a real-estate broker, lettings agent, tourism agency, booking agent, insurance provider, escrow service, or financial institution.
  3. Velocci does not own, manage, control, or operate any Listing or accommodation and is not a party to any rental agreement between a Host and a Guest.
  4. Velocci does not guarantee any number of booking requests or the suitability, legality, conduct, background, or identity of any Guest.
  5. The Host–Guest relationship is formed directly between the Host and the Guest. Velocci is not a contracting party and bears no liability for disputes arising from it.

2. Host Eligibility and Account Registration

To become a Host, you must:

3. Verification and Compliance

3.1 Identity Verification

Velocci requires all Hosts to complete an identity verification process before Listings are published. This may include live ID checks, photos, or videos.

3.2 Property and Address Verification

Velocci may request additional verification, such as property video verification, address confirmation, or licensing documentation. Failure to comply may result in suspension or removal of Listings.

3.3 Use of Third-Party Services

Velocci may use trusted third-party verification providers to complete these checks as required by law or for platform integrity.

3.4 Non-Compliance

Failure to complete verification or providing false or incomplete information may result in suspension, removal, or termination without refund.

4. Host Representations and Warranties

5. Listings, Content, and Intellectual Property

5.1 Listing Accuracy

Hosts are solely responsible for the accuracy of their Listings, including descriptions, photos, amenities, pricing, and availability. Velocci may edit or remove Listings that violate these Terms or applicable laws.

5.2 Content License

By uploading content, the Host grants Velocci a worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, modify, translate, and display such content for Platform operation, marketing, or affiliate distribution.

5.3 Image Removal

Hosts may request permanent deletion of images. Velocci will remove them from active use within 60 days of confirmation. Content on partner sites may take longer due to external policies.

7. Bookings, Cancellations, and Overbooking

7.1 Booking Obligations

A confirmed booking forms a binding contract between the Host and Guest. Velocci is not a party to this contract. Hosts must ensure their calendars are accurate and up to date.

7.2 Host Cancellations

If a Host cancels a confirmed booking, they are responsible for all resulting costs and consequences, including guest inconvenience, relocation, or refund. Velocci may:

  1. Deduct administrative or compensation costs from Host payouts;
  2. Invoice the Host for related losses;
  3. Adjust the Host's ranking or visibility;
  4. Suspend or terminate the account.

7.3 Repeated or Unjustified Cancellations

Repeated or unjustified cancellations may lead to higher penalties, account suspension, or permanent removal.

7.4 Overbooking and Alternative Accommodation

If a Host cannot honour a confirmed booking, they must immediately notify the Guest and Velocci and:

  1. Provide alternative accommodation of equal or better standard at their own cost;
  2. Arrange or reimburse transport to the new accommodation;
  3. Compensate the Guest for reasonable expenses.

Velocci may assist in relocation and recover costs from Host payouts. Repeated incidents may result in account termination.

7.5 Notification Requirement

Hosts must notify Guests and Velocci immediately via the Platform if they cannot fulfil a booking.

8. Ranking and Visibility

Velocci determines how Listings appear and may adjust algorithms at any time. Ranking depends on factors such as price, availability, reviews, responsiveness, subscription level, and overall performance. Velocci provides no guarantee of visibility or ranking.

9. Reviews, Bookings, and Payment Conduct

9.1 Guest Reviews

Guest reviews are owned by Velocci, which may publish, edit, or remove them at its discretion. Hosts must not manipulate or incentivize reviews.

9.2 On-Platform Bookings and Payments

All bookings must be initiated and confirmed through the Platform. Hosts must not encourage or request Guests to cancel Platform bookings to complete off-platform transactions.

Where permitted, Hosts may accept cash payments at check-in provided that:

  1. The booking remains registered and confirmed on the Platform;
  2. Payment status is marked accordingly in the Host dashboard;
  3. The Host complies with all applicable tax and receipt-issuing obligations.

Any attempt to divert Guests or conceal bookings to avoid fees may result in account suspension or termination.

9.3 Payment Security and Restrictions

Hosts must not, through the Platform, its messaging system, or any part of their account, request, collect, display, or store any Guest's credit-card details, bank-account information, digital-wallet data, or other payment credentials.

Hosts must not use the Platform to send or display:

All payments must be processed either:

  1. Through authorised LocalStays payment methods; or
  2. Directly at the property only if cash payment is explicitly permitted by Velocci.

Violation of this clause constitutes a serious breach and may result in immediate suspension or termination.

10. Subscriptions, Fees, and Taxes

  1. Publishing Listings may require an active subscription or service fee.
  2. Subscription prices and terms are published on the Platform.
  3. Velocci may update pricing and payment schedules with reasonable notice.
  4. Hosts are solely responsible for determining, collecting, reporting, and remitting all taxes, levies, and duties applicable to their activities, including but not limited to:
  5. Hosts must comply with all tax reporting and declaration obligations under local law, including guest-registration requirements with tourism authorities.
  6. Velocci does not act as a tax agent and bears no liability for unreported or unpaid taxes.
  7. Hosts are encouraged to consult a tax advisor to ensure compliance.

11. Data Protection and Communications Monitoring

Velocci processes personal data as described in its Privacy Policy. Velocci may monitor Host–Guest communications for fraud prevention, quality, and compliance. Hosts may use Guest data only to manage bookings and must comply with applicable privacy laws. Velocci may share limited data with payment providers, verification partners, or affiliates as required for Platform operation.

12. Fraud, Compliance, and Enforcement

Velocci may suspend or terminate accounts involved in fraud, money laundering, or non-compliance. Velocci may request supporting documents or perform compliance checks at any time.

13. Force Majeure and Platform Availability

Velocci shall not be liable for failures or delays due to circumstances beyond its reasonable control, including natural disasters, war, pandemics, or system outages. Velocci may temporarily suspend access for maintenance or upgrades.

14. Indemnity and Limitation of Liability

Hosts agree to indemnify and hold harmless Velocci, its affiliates, and employees from any claims, losses, damages, or expenses arising from:

Velocci's total liability shall not exceed the total fees paid by the Host in the preceding twelve (12) months. Velocci shall not be liable for indirect, incidental, or consequential damages.

15. Insurance

Hosts are solely responsible for obtaining property and/or liability insurance. Velocci does not provide insurance.

16. Suspension and Termination

Velocci may suspend or terminate accounts immediately for breaches of these Terms, fraud, illegal activity, repeated cancellations, or non-payment of fees. Termination does not release the Host from obligations incurred prior to termination. Hosts may close their account at any time upon written request.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Montenegro. However, if a Host registers and acts as a business entity (company or trade), these Terms shall instead be governed by and construed in accordance with the laws of England and Wales, and any disputes shall fall under the exclusive jurisdiction of the courts of London, United Kingdom.

Nothing in this clause limits the application of mandatory local laws concerning property licensing, taxation, or tourism regulation.

18. Amendments

Velocci may update these Terms from time to time. Material changes will be communicated via email or Platform notice. Continued use after such updates constitutes acceptance.

19. Language and Interpretation

These Terms are provided in both English and Serbian. In case of conflict, the English version prevails.

20. Entire Agreement

These Terms constitute the entire agreement between Velocci D.O.O. and the Host and supersede all prior understandings or communications.
